NYC Soda Ban
Overturned |
The New York State Appeals court
overturned New York City’s controversial ban on soda.
A New York Trial Court had earlier strike down the
law, but the ruling was appealed.
The decision is now final.
No more soda ban in New York City.

This is a victory for
the many organizations that banded together to fight the
mayor on this issue and win a victory for small businesses
in the City, especially neighborhood restaurants and grocery
stores.

“The ban on soda was clearly an
abuse of the Mayor’s executive power and we’re pleased that
the court agreed,” said NFIB Small Business Legal
Center Director Karen Harned. “The mayor does not
have the power under the state Constitution to supervise
personal decisions between private businesses and their
customers.”
